Description | Upon the petition given on 24 October 1904 by Süleyman bin Unmân [Osman], on behalf of the family of Ebû Es Su’ud [Ebussuud], regarding their claim to the road usurped from their land in the village of Silvân, by Hüseyin bin Halil Hüseyin and his brother Hamad, who are both from the village of Silvân Following this petition, a council member and a municipal engineer were sent to the said location in order to realize necessary inspection and investigations and draw up a map. According to the inspection, investigation and hereby presented map, it has been understood that Hüseyin bin Halil Hüseyin and his brother Hamad, who are both from the village of Silvân, dared to enclose and usurp an old road reaching to Silvân, 57 arşın in length and 6 arşın, and also usurped a part of a land, located next to it and specified in this petition to belong to the petitioners, thus opening a new road. The 254th article of the 3. section of the Penal Code clearly states that reparation cost shall be collected from the person ruining public roads and stealing from their length or width; and that, after the stolen part is reclaimed, s/he shall be sentenced to 3 days to 1 week of imprisonment and a fine of 15 five-piaster piece to 20 five-piaster piece shall be imposed on them. In order to take criminal actions regarding the said persons, it is thus appropriate to relegate the matter to the municipal police force to, at first, revert the enclosed and usurped road to its previous status as shown in the map, and to have a gendarme escort the municipal engineer to be sent there for installing fixed signs.
