Description As it has been explicated, the Armenian monastery, which has been constructed 50-60 year ago and which is located on the westside of the city is adjoint to the city walls and circumscribed by the military barracks on the northside. Permits have been issued by the municipal council to the Greek Patriarch for the construction of buildings outside the Jaffa Gate excluding the buildings belonging to Hananya Effendi, and to Hananya Effendi for the construction of his building with the condition that the buildings will not be conjoined with the city walls. The Patriarchate, was likewise built 40 years ago. By no means a permit was issued to Hananya Effendi giving him permission to build houses whether inside or outside the city walls adjoint to the city walls. On the contrary, he was filed a lawsuit at the lower court for adjoining his own building to the city walls on his own accord. Since the protection of the mentioned city walls concerns the military, the municipal council cannot be present as the plaintiff, and a court order number 7, and dated 3 July 1883 has been issued for the dismissal of charges and for the prevention of the town hall from any further attempts. Following the questions and statements received from the Army, this situation, after mentioning the decisions of the lower court, has been communicated to the Commandant of Jerusalem on 21 January 1891. Additionally, it is relevant to state that, no construction is underway outside the city, in the confines of the abovementioned city walls, other than the cistern which is being constructed in the middle of the property belonging to the Latin Monastery.
