Description | Upon the petition presented by all carriage drivers on 7 June 1909 regarding the non-collection of the due sums from the Jerusalem-Jaffa macadam tax This petition has been examined by our council. It was explained in the Sanjak Administrative Council’s decision dated 18 August 1909 and numbered 601 that, following the re-implementation of the Constitution, a consultation be hold concerning some of the municipal taxes and nothing be taken from the said taxes until an answer is taken on this subject; but an official from the municipal office be employed for recording the accrued sums. This decision has been duly implemented thus far. With reference to the Financial Department of the Council of State’s mandate dated 11 April 1909 and numbered 462, it has been ordered this time in the Ministry of Internal Affairs’ letter dated 4 May 1909 and numbered 53 that the Jerusalem-Jaffa macadam taxes, used in exchange for the fixed expenses of the hospital reserved for the Ottoman subjects in Jerusalem and Muslim visitors, be taken the way they used to be. Hence, from the date of its suspension to the end of April of this year (13 May 1909), there has accumulated a due sum of 41,729 piasters in accordance with the document certified by the officials and carriage drivers in charge of the said taxes. A mandate dated Mart 1325 (1909) was presented by our council for the collection of this sum and relegated to the Gendarme Commandership. The Municipal Police Force attempted to take due action in respect thereof; however, some drivers opposed the payment of the said taxes belonging to Abdülhamid Al Dakkak, leading to the presentation of this petition. This petition states that the said taxes are not certified by the Parliament; that, if it is arranged only on the approval of the Council of State, a copy of the specified letter by the Ministry of Internal Affairs be given in order to be able to raise an objection against it; and that these drivers are provoked in order not to pay these taxes. As this has been considered to be contrary to the notified orders, it is appropriate to relegate the matter to the Gendarme Commandership for collecting, in accordance with the mandated presented by our council and the order in this respect, the sums owed by the petitioners to the municipality for the said taxes.
