Description

Before the transfer of the reparation of the macadam going from Jerusalem to Jaffa to Public Works Administration, its estimated cost of reparation was put to Dutch auction in 1306 (1890-1891) and, after the completion of bidding, it was decided that it be undertaken by Corci İzzetnaki (?) through the guarantee of Corci Patridi (?), at a rate of 150 thousand piasters. The result of this auction was approved with the verdict given by the Sanjak Administration Council on 2 October 1890. When the said contractor left for İstanbul without making the reparation of the macadam as he had promised, a suit was filed against his guarantor at the Jerusalem Court of First Instance, and he was condemned to pay a penalty of 118,604 piasters. Although a copy of the judgment as regards this matter was given, the said Corci Patridi did not accept the judgment and filed a suit at the Beirut Court of Appeal. It was decided that the verdict given by the Jerusalem Court of First Instance be repealed and a new suit be filed in Jerusalem, so the suit was tried again in the Jerusalem Court of First Instance. In accordance with the herewith presented court verdict, the said guarantor has been condemned to pay a penalty of 500 French liras to the municipal council, and seven years have passed since the beginning of the trial of this suit. If this court decision is not acknowledged, a new suit is filed, courts of appeal shall intervene and the conclusion of the process shall take a few years more. It is appropriate to relegate the matter to the Sanjak Administrative Council to declare whether it is necessary to acknowledge this court decision or to refer to the court of appeal. The 12th of Tishrîn Thânî (1)313 (24th of November 1897).
