Description | Upon the petition given on 6 November 1905 by the townsfolk of Nebî Şemuyel The said place was inspected and it was understood that an unlicensed room was started to be constructed last year by İlyân Abid (?) from the village of Nebî Şemuyel on the land located in the said village on the street extending from the west to the north, with a real width of 3 to 3.5 arşın. Even though its property status is now being tried at the Court of First Instance and it has been called to a halt, an attempt has been made to complete the construction of this room at the present moment. It has been understood from the above-written statement by the municipal engineer that the road is being trespassed upon with this construction attempt, and that the road has to be converted to its previous status as its width consists now of only one arşın. In the 264. article of the Penal Code, it is clearly stated that reparation costs shall be collected from those ruining places such as public roads, squares and places of spectacle all reserved for common good and stealing from their length or width; and that, after the stolen part is reclaimed, they shall be sentenced to 3 days to 1 week of imprisonment, and a fine of 15 five-piaster piece to 20 five-piaster piece shall be imposed on them. For the conversion of the said road to its original status, it has been considered to collect 220 piasters in total from İlyân Abid; 45 piasters for sending the municipal engineer Nasri Effendi to there and his daily allowance, 100 piasters for reparation cost of the road, and 75 piasters as a fine. Yet, it has also been deemed suitable to apprehend him for three days. For taking due actions in respect thereof and having a cavalier escort the said engineer, it is appropriate to relegate the matter to the municipal police force.The 3rd of Kânûn Awwal (1)321 (16th of December 1905). |
