Description | About the Spanish note. Legitimate rights and interests of Catholicism (from the point of view of its religious institutions) and Spain in Palestine. Advantage, utility (for the increase of the Catholic patrimony in the Holy Land and for the legitimate satisfaction of Spanish piety and national self-love) of the acquisition of vacant sanctuaries and the creation, by Spain, outside the Franciscan Custody, of Spanish national establishments, exclusive properties and under the absolute protectorate of Spain. Maintenance of the religious privileges of the Spanish Crown, granted by the Holy See (in recognition of its immense alms) in the convents of the Franciscan Custody under the protectorate of France. Titles of ownership of the establishments of the Franciscan Custody: Pious Bequest (wacouf) in favour of the indigenous Latin population. Naked properties of the territorial sovereign. Possession of the Holy See, which has entrusted its housing, custody, maintenance and use to a minor order: the Franciscan Custody. According to our treaties and conventions with the territorial sovereign and with the religious consent of the Holy See; all these convents of the Franciscan Custody and their rights are under the protectorate of France. None of these convents recognized by the territorial sovereign nor by the Holy See as: French, Spanish... Alms in the hands of Franciscan religious, minor order; goods of the Holy See as soon as they are in their hands, as well as the acquisitions made by the latter of whatever country or power they come from. Custody, housing, administration, maintenance at the Franciscan Custody under the protectorate of France. No exception to the territorial sovereign or the Holy See regarding the convent of Damascus.
